Legal Terms

We use these basic terms throughout the agreement, and they have specific meanings. You should know what we mean when we use each of the terms.

The “Service(s)” refers to the applications, software, and message board services provided by Alien Babble.

“The User,” “You,” and “Your” refer to the individual person, company, or organization that has visited or is using the Website or Service; that accesses or uses any part of the Account; or that directs the use of the Account in the performance of its functions. A User must be at least 13 years of age.

“Alien Babble,” “We,” “Us,” and "Our" refer to Alien Babble, as well as our staff.

“Content” refers to content featured or displayed through the Website, including without limitation text, data, articles, images, photographs, graphics, software, applications, designs, features, and other materials that are available on the Website or otherwise available through the Service. "Content" also includes Services. “User-Generated Content” is Content, written or otherwise, created or uploaded by our Users. "Your Content" is Content that you create or own.

An "Account" represents your legal relationship with Alien Babble. A “User Account” represents an individual User’s authorization to log in to and use the Service and serves as a User’s identity on Alien Babble.

The “Website,” and the "Site" refers to Alien Babble's website located at alienbabble.com

I. Terms of Service

By joining this site, you acknowledge and consent to the Terms of Service, Cookie Policy, and Privacy Policy. These terms of use affect your legal rights and obligations. Please read these terms of use carefully before using the services. Your access to and use of the services is conditioned on your acceptance of and compliance with these terms of use.

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND OUR PRIVACY POLICY, FOUND AT AND INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THE TERMS OF USE, ALIEN BABBLE DOES NOT GRANT YOU THE RIGHT TO, AND YOU MUST NOT, ACCESS OR USE THE SERVICES.

ACCOUNTS WITH ZERO POSTS ARE AUTOMATICALLY DELETED FROM THE MEMBER LIST AND REGISTRATION.

The providers ("we", "us", "our") of the service provided by this web site ("Service") are not responsible for any user-generated content and accounts. Content submitted express the views of their author only. Please be aware that as a privately-run Service, the "User's" freedom of speech ends where our liability begins. If the two conflict, Our Terms of Service and interests will prevail.

This Service is only available to users who are at least 13 years old. If you are younger than this, please do not register for this Service. If you register for this Service, you represent that you are this age or older. If you are under the age of 18, you and your parent(s) or legal guardian(s) acknowledge to have reviewed these Terms of Service and assent to these Terms of Service on Your behalf and take full responsibility for Your compliance with them. You and your legal guardian(s) also agree that by using the Service, you may be exposed to Content that you find objectionable, and it is your, and their sole responsibility, to determine whether the Content in Alien Babble is suitable for you. All Content you submit or upload may be sent to third-party verification services (including, but not limited to, spam prevention services). Do not submit any Content that you consider to be private or confidential.

You agree to not use the Service to submit or link to any Content which is defamatory, abusive, hateful, threatening, spam or spam-like, discriminatory (insult members based on their religion, race, gender, age, political beliefs, or sexual orientation), libelous, fraudulent, likely to offend, contains adult or objectionable content, contains personal information of others, risks copyright infringement, encourages unlawful activity, or otherwise violates any laws. You are entirely responsible for the content of, and any harm resulting from, that Content or your conduct.

You agree not to create multiple accounts. If a sockpuppet or alternative account is identified, it will be banned immediately.

We may remove or modify any Content submitted at any time, with or without cause, with or without notice. Requests for Content to be removed or modified will be undertaken only at our discretion. We may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice.

You are granting us with a non-exclusive, permanent, irrevocable, unlimited license to use, publish, or re-publish your Content in connection with the Service. You retain copyright over the Content.

You are responsible‍️ for all content posted and activity that occurs under your Account (even when content is posted by others who have legal access to your Account).

You are responsible for maintaining the security of your Account and password while you use our service. We offer tools such as two-factor authentication to help you maintain your Account's security, but the content of your Account and its security are up to you. Alien Babble cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You will promptly notify Alien Babble if you become aware of any unauthorized use of, or access to, our Service through your Account, including any unauthorized use of your password or Account.

You agree not to pirate, reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without Alien Babble's express written permission.

All content must be posted in English for the benefit of our diverse community and moderation purposes. All references in another language should be provided with an English translation.

Do not disclose in any way classified material that could be prejudicial to the national security and interests of the United States.

These terms may be changed at any time without notice.

If you do not agree with these terms, please do not register or use the Service. Use of the Service constitutes acceptance of these terms. If you wish to close your account, please contact us.

II. Privacy Policy

We respect the privacy of everyone who visits our site. We do not collect personal information about our users without their knowledge and prior consent. No scripts or devices are used for this purpose. In order to use certain features of our website we may ask you to register by entering some personal information and accept our Cookie Policy. This information is given voluntarily and will be used only as stated in our Privacy Policy. This information will not be given, traded or sold to any third party without the user's knowledge and prior consent.

The California Consumer Privacy Act (CCPA), gives residents of the state of California the right to prevent businesses from selling their personal information. Alien Babble is NOT a business and we take your privacy very seriously. We do not sell your personal information.

III. Code of Conduct: Improper Use of Service

While using the Site or Service (including in connection with any User-Generated Content), you will not, and will not induce any third party to:

Use the Site, Services or any of the Site Information in a way that is unlawful, harms Alien Babble or any user of the Site, or otherwise violates the rights of any party.

Use the Site, Services or any of the Site Information in a way that could overburden, or impair the Services (or the networks or systems connected to such).

Attempt to disable or circumvent any security mechanisms used by the Services, or otherwise attempt to gain unauthorized access to any portion or feature of the Site, Services, or any other systems or networks connected to the Site or Services, or to any server of Alien Babble or its third party service providers, by hacking, password "mining", or any other illegal means.

Use any "deep-link", "page-scrape", "robot", "spider", or other automatic device, program, algorithm or methodology, or any comparable manual process, to access, acquire, copy, or monitor any portion of the Site, Services or Site Information.

Upload, post, host, or transmit any content that: contains or installs any active malware, use any device, software, instrumentality or routine to interrupt or interfere with, or attempt to interrupt or interfere with, the proper operation and working of the Site or Services, or with any other person's use of the Site or Services.

Breach any security measures implemented on the Site or Services or in the Site Information.

Track or seek to trace any information on any other person who visits the Site or uses the Services and/or engage in doxxing (reveal someone else’s personal information).

Use the Site, Services or Site Information for, or in connection with, any illegal purpose, to solicit, facilitate, encourage, condone, or induce any illegal activity, or as otherwise prohibited by these Terms of Use or applicable laws, rules or regulations, including, without limitation, laws applicable to the export of software and data or copy, modify, create a derivative work of, reverse engineer, decompile, or otherwise attempt to extract the source code of any proprietary software used to provide, maintain, or otherwise applicable to, the Site, Services or Site Information, or otherwise made available to you in connection with the Site, Services or Site Information; or use the Site, Services or Site Information in any manner that otherwise violates these Terms of Use.

IV. Intellectual Property and Law Enforcement Policy

Alien Babble respects the intellectual property of others, and we ask you and all users to do the same. When citing references, please link to content rather than posting it in its entirety, unless you are the copyright holder or have permission from the copyright holder. Please note that all embedded, User-generated media posted on Alien Babble is hosted on third-party servers not affiliated with us.

If you believe that Content on the Services violates your copyright, please send us a notice of the violation using the following contact information: Copyright Complaints. Your notice must include: a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; identification of the material that is claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to permit us to locate the material; a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Upon receipt of a notice of claimed infringement that satisfies these requirements (or any statement in conformance with 17 U.S.C. § 512(c)(3)) , Alien Babble will act expeditiously to remove or disable access to any Content that is claimed to be infringing upon the copyright of any person under the laws of the United States and will terminate the access privileges of those who repeatedly infringe on the copyrights of others. United States law imposes substantial penalties for falsely submitting a notice of copyright infringement.

Alien Babble shall have the right to monitor and/or record your communications when you use the Service, and you acknowledge and agree that when you use the Service, you have no expectation that your communications will be private. Alien Babble shall have the right to disclose your communications for any reason, including: (a) to satisfy any applicable law, regulation, legal process or governmental request; (b) to enforce the terms of this Agreement or any other Alien Babble policy; (c) to protect Alien Babble's legal rights; (d) to protect the health or safety of anyone that Alien Babble believes may be threatened; or (e) to report a crime or other offensive behavior. Alien Babble shall fully co-operate with any law enforcement authorities or court order requesting or directing Alien Babble to disclose the identity or locate anyone who uses the Services in violation of any applicable laws or these Terms of Use.

V. Suspension and Termination Policy

Alien Babble, as it deems necessary and in its sole discretion, may suspend or terminate your account at any time. Without limiting the foregoing, we may restrict, suspend or terminate your access to all or part of the Services if we believe you are in breach of these Terms of Use or applicable law, or for any other reason, without notice or liability. Alien Babble reserves the right to refuse provision of or access to the Services to anyone for any reason and at any time. Any termination or suspension of the Services may result in the deactivation or deletion of your account or access to your account, and may also result in the forfeiture and relinquishment of all content in your account, as determined by Alien Babble in its sole discretion.

Services may be terminated by YOU without cause, by following the cancellation procedures; (a) stop using the Service; (b) submit a request to remove Personally Identifiable Information from public view.

Verbal, physical, written or other abuse (including attacks, intimidation, harassment, stalking, bigoted, sexist and racist comments, threats of abuse or retribution, trolling, flaming, and goading) of any Alien Babble member or staff may result in immediate account termination. We reserve the right to not intervene in interpersonal disputes.

Upon termination, all User privileges granted to you in these Terms of Use will immediately cease. If we terminate your access to the Services, your User-Generated Content may persist and appear within the Services. This information, including your User-Generated Content, comments, and all other data will no longer be accessible to you and cannot be recovered once your account is terminated, and Alien Babble shall not be liable for any claims or losses resulting from such deletions.

Methods for enforcing our Terms of Service and Rules include, but are not limited to: public or private warning, temporary or permanent suspension of accounts, removal of privileges from, or adding restrictions to, accounts.

VI. Links to Third Party Websites; Third Party Products and Services

The Services may contain links to or interactions with third-party websites or resources ("Third Party Websites"). These links and interactions are provided for your convenience only. Alien Babble neither endorses nor controls such Third Party Websites, and you acknowledge and agree that we are not responsible or liable for the information, content, products, or services on or available from such Third Party Websites, or for the results to be obtained from using them. If you choose to access any such Third Party Websites, you do so entirely at your own risk.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF INFORMATION FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALIEN BABBLE DO NOT WARRANT THAT THE SERVICES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR FREE. ALIEN BABBLE DOES NOT CONTROL, ENDORSE, OR TAKE RESPONSIBILITY FOR ANY CONTENT AVAILABLE ON OR LINKED TO THE SERVICES OR THE ACTIONS OF ANY THIRD PARTY OR USER, INCLUDING MODERATORS. WHILE ALIEN BABBLE ATTEMPTS TO MAKE YOUR ACCESS TO AND USE OF OUR SERVICES SAFE, WE DO NOT REPRESENT OR WARRANT THAT OUR SERVICES OR SERVERS ARE FREE OF MALWARE OR OTHER HARMFUL COMPONENTS.

VIII. Disclaimer of Liability

IN NO EVENT AND UNDER NO THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE, WILL THE ALIEN BABBLE ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES, INCLUDING THOSE ARISING FROM OR RELATING TO CONTENT MADE AVAILABLE ON THE SERVICES THAT IS ALLEGED TO BE DEFAMATORY, OFFENSIVE, OR ILLEGAL. ACCESS TO, AND USE OF, THE SERVICES IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM.
